NO SOLICITATION POLICY:

Our virtual and live events, including ZOOM Meetings, Membership ZOOM Calls, ZOOM "meet-ups," conferences, masterminds, trainings, summits, bootcamps, and expositions, maintain a strict no-solicitation policy. This policy is in place to create an undisturbed environment for our attendees and guests, and prohibits any solicitation by unauthorized parties or attendees. This policy encompasses a range of unauthorized activities and applies to all of the aforementioned events.

The following activities are prohibited:

Hosting unauthorized receptions, parties, or off-site events.

​Displaying unauthorized exhibits, mobile exhibits, or hospitality suites.

​Conducting unauthorized membership recruitment activities.

​Creating unauthorized subgroups on social media platforms, such as WhatsApp.

​Selling any product or service not offered by an affiliated RaisingCapital.com Company at the event.

​Promoting non-RaisingCapital.com Company events without authorization.

Recruiting for employment without authorization.

​Making unwelcome advances toward event participants.

​Distributing printed or electronic materials, such as literature, signs, flyers, invitations, tickets, forms, etc., on-site without authorization (business cards are an exception).

​Sending virtual invitations to any of the aforementioned prohibited activities without authorization.

​Using the venue's Wi-Fi, guest Wi-Fi, or Company's Wi-Fi for self-promotional or solicitous purposes without authorization.

​Using the venue for self-promotional or solicitous purposes without authorization.

Any individual or entity found to be in violation of this policy will be removed from the event without a refund and may face legal action for any resulting damages. Attendees who violate this policy agree to pay RaisingCapital.com Company(ies) affected an amount equivalent to a Sponsor or Exhibitor fee, as well as a pro rata portion of the event's costs. Attendees who violate this policy will also be immediately expelled from the event and may be disqualified from attending future events, at the discretion of any of the RaisingCapital.com Companies.

The use of photography or videography equipment, as well as filming and recording (audio or video), is strictly prohibited. Any reposting of recorded materials will be considered a violation of our trademark and copyright, and will be subject to legal action. We do not permit the dissemination or commercial use of recordings of our events, including video and audio.

To ensure confidentiality and respect for all attendees, the use of any video, photography or audio equipment during this event is strictly prohibited. Any violation of this rule, whether by amateur or professional equipment, may result in the participant's removal from the venue without re-entry and forfeiture of their ticket(s). Only invited or pre-registered members of the press with verified credentials will be allowed entry, and they must wear their Press Badge at all times and be prepared to show their credentials. As a private event, RaisingCapital.com reserves the right to deny entry to any participant without explanation, and must also abide by the venue's rules and regulations. Any violation of these rules, by a participant or vendor, may result in immediate removal from the premises without refund.

USER CONTENT GUIDELINES:

These terms govern your submission of content on the Websites. The Websites may have interactive features such as comments sections and discussion forums (collectively known as "Interactive Areas") where you can upload or post user-generated content, including messages, photos, videos, and other materials (collectively, "User Content"). You are solely responsible for using Interactive Areas at your own risk. Interactive Areas are only available for users aged 13 years and above. By submitting User Content to an Interactive Area, you confirm that you are at least 13 years old. If you are below 18 years old, you must be emancipated or have your parent or legal guardian's consent to submit content and agree to these Terms.

By attending any Event, you grant RAISINGCAPITAL.COM and its affiliates, designees, successors, assigns, and licensees the right to film and record you and use your name, image, and likeness in any media for advertising, promotional, or any other purpose, including future events produced by RAISINGCAPITAL.COM or its affiliates. You also release RAISINGCAPITAL.COM, its designees, successors, assigns, licensees, and affiliates from any liability arising from the use of your name, image, and likeness.

By submitting User Content or participating in Interactive Areas within or in connection with the Websites, you agree not to upload or post User Content that

(a) violates the rights of others, including statements that defame, harass, stalk, or threaten others;

(b) is false, misleading, or inaccurate;

(c) contains offensive content such as bigotry, racism, hate speech, vulgarity, or profanity;

(d) contains pornography, sexually explicit content, pedophilia, incest, bestiality, or any obscene or lewd material;

(e) violates the law, advocates dangerous or illegal acts, or discusses illegal activities with the intent to commit them;

(l) uses the name or likeness of a person without their consent. You are solely liable for any damage resulting from the infringement of copyrights, trademarks, trade secrets, rights of publicity, or other proprietary rights, or any harm resulting from such submission. 

RAISINGCAPITAL.COM may bar any person who violates the intellectual property or other rights of others from submitting or posting further material on the Websites. It is your responsibility to determine if User Content is protected by any proprietary rights.

You agree to refrain from uploading, posting, or transmitting any User Content, software, or other materials that contain viruses or any harmful or disruptive components. You also agree not to utilize any technology, service, or automated system to post more User Content than what an individual can upload within a given period of time. You further agree not to direct any third party to use these services, technologies, or automated systems on your behalf. Any action that we deem as restricting or inhibiting others from using or enjoying the Websites is strictly prohibited. We do not take any responsibility or assume liability for the accuracy or credibility of any User Content. We also do not take any responsibility for any actions you may take as a result of reading User Content posted on the Websites. LIVE EVENTS:

Attending one of our live events means that you will be participating in a live-streamed and recorded event. Photographs and video segments will be taken throughout the event by RaisingCapital.com, as well as by other third-party participants, such as speakers and sponsors. By purchasing a ticket for any live event, you acknowledge that it includes a WAIVER AND RELEASE and agree to the following:

I grant permission to RAISINGCAPITAL.COM and all affiliated companies to use my likeness in any photograph, video, or other digital media ("photo") in any of their publications, including web-based publications, without payment or other consideration. I waive any right to inspect or approve the finished product in which my likeness appears and any right to royalties or other compensation related to the use of the photo. My actual testimony will not be edited, and I acknowledge that there will be no compensation for my testimonial. All photos and videos will become the property of RAISINGCAPITAL.COM and all affiliated companies and will not be returned.

I release RAISINGCAPITAL.COM and all affiliated companies from all claims, demands, and causes of action arising from this authorization. If my testimony is cut or not used, I agree that this was at the artistic discretion of RAISINGCAPITAL.COM and all affiliated companies, and I will not take legal action. I also agree that any claims will be arbitrated through the American Arbitration Association, and the jurisdiction for any and all claims in California.

I waive all claims arising from such use by RAISINGCAPITAL.COM and all affiliated companies, including claims for libel or invasion of privacy. I have read and am fully familiar with the contents of this Release, which contains the entire agreement between the parties and supersedes any other agreement.

Be advised that we cannot supply an Invitation Letter or any immigration documentation to support your Visa application for travel to the United States. We suggest that international buyers secure a travel visa before buying a ticket to the live event. We cannot assist with any documentation for those living in countries that prohibit travel to the United States. Please be aware that tickets are eligible for refunds only through specific programs mentioned in these terms and conditions.

Refund and Transfer Policy:

You have the option to request a 100% refund up to 30 days before the live event . If a request is received less than 30 days but 14 days before the event you will receive a credit. This credit can be applied towards any RaisingCapital.com product or used for a future live event.

NO REFUNDS OR CREDITS WILL BE GRANTED FOR REFUND REQUESTS RECEIVED LESS THAN 14 DAY FROM EVENT START DATE.

​Credit is only applicable to tickets purchased without restrictions, excluding tickets obtained through promotional agreements or "gift with purchase" arrangements. Such tickets are not eligible for credit, refund, or transfer and will become void if unused.

Processing fees on ticket purchases are non-refundable and not eligible for credit.

​Hotel room bookings, if included with your ticket, are non-refundable and non-transferable to other events.

Change Fee for Ticket Transfers:

If you choose to transfer your ticket to another live event, a one-time change fee of 25% of the ticket price or $500.00, whichever is lower, will apply.

Payment for Hotel Accommodations:

If your live event purchase includes hotel accommodations, full payment must be made at least 30 days before the event. Failure to do so will result in the forfeiture of your hotel room without refund or credit.

​Hotel accommodations are limited and available while supplies last. We cannot guarantee room availability if payments are not made on time.

​After purchasing your ticket, it is essential to reserve your seat. Failure to do so will result in the forfeiture of your ticket, and you will receive a store credit for the amount paid, minus processing fees.

​Gratis tickets or those received as part of another purchase will be forfeited without credit and are not valid for future events.

Security and Event Entry:

In accordance with federal and state laws, we reserve the right to refund ticket purchases and deny event access if necessary for public safety.

​All ticket holders must present state or federal identification matching their ticket name.

​Security searches may be conducted upon entry. Refusal to consent to such searches may result in denied entry without refund, credit, or compensation.

​Certain items, including firearms, alcohol, drugs, recording devices, and more, may not be brought into the event premises under facility rules.

Ticket Resale and Counterfeiting:

Unlawful resale, counterfeiting, or copying of tickets will result in ticket forfeiture without credit, refund, or compensation.

​We reserve the right to restrict or deny ticket purchasing privileges to individuals violating our policies.

Suite and Sponsorship Table Policies:

For suite or sponsorship table purchases, you must provide the names of all attendees and may not sell any space in your purchased suite or table. These are non-transferable.

Disruptive Conduct and Ejection:

We reserve the right to refuse admission or eject individuals displaying disruptive or disorderly conduct not aligned with the event's purpose.

Such individuals will not be eligible for refunds, credits, or compensation for any incurred expenses.

Privacy and Media Release:

By attending the event, you acknowledge that your actions and conduct are public, with no expectation of privacy.

​You grant permission for us, the venue, and our affiliates to use your name, image, likeness, and recorded content for any purpose without further authorization or compensation.

Ticketing and Age Requirement:

To gain entry into a Live Event, a valid ticket is required for each attendee and is only valid on the specified date(s) and area(s) indicated on the ticket. Admission is restricted to those who meet the minimum age requirements, which is 18 years or older, unless the event permits children. Children require their own ticket for entry and will be denied access without one.

Please note that infants, including those in strollers, portable car seats, diaper bags, backpacks, and strollers, are not permitted to attend the event. The Company must comply with the rules and regulations of the Live Event arena.

Acceptable forms of identification that demonstrate proof of age include a government-issued passport or driver's license with photo (U.S. or Canada), military identification card with photo, or government-issued identification card with photo. The name on the ticket must match the name on the identification. No other forms of identification will be accepted. If you fail to provide valid identification, you will not be permitted to enter the event and will not be entitled to a refund or other damages. Additionally, during the event, you may be asked to provide valid identification upon request by a member of security or crew. Failure to do so may result in your prompt ejection from the event without refund.

Terms for Digital Product Purchases: 

All digital product purchases, including digital gift cards, are non-refundable. Once a digital product is purchased, the sale is final. We strictly adhere to our no refund and no early cancellation policy for all digital and downloadable products.

For training programs, access will be granted for the specified duration mentioned in the product description. Please note that the purchase of a training program does not provide rights to share, reproduce, or resell the product in any manner.

Cancellation of a subscription to a digital product becomes effective immediately, and no refunds will be issued regardless of product usage.

If you encounter any difficulties accessing the digital content you've acquired, please promptly contact our customer service department at Support@RaisingCapital.com. We will work diligently to resolve any issues you may encounter.

Offer and Coupon Usage Restrictions: 

Unless explicitly specified in writing, special offers and coupons cannot be stacked with other special offers or coupons. These promotions are only valid while supplies last and during the specified time frames indicated on them. Please be aware that prices may change without prior notice. If your account is in arrears or not in good standing for any reason, you will not be eligible for any special offers, flash sales, promotions, bonuses, gift with purchase offers, coupon discounts, or incentives.

Terms Regarding Monthly Payment Plans:

When you opt for a monthly payment plan to purchase a product or service, you assume responsibility for fulfilling 100% of the agreed-upon payments. In the event that any payments are not received, the entire purchase will be canceled, and the payments made up to that point will be forfeited without the possibility of a refund. Furthermore, access to any digital product or program will be revoked.

For payment plans that encompass live events, it is imperative that the total amount is paid in full at least 30 days prior to the event date. Failure to do so will result in the forfeiture of your event ticket, and you will receive store credit equivalent to the payments made up to 30 days from the event date.

No Guarantee Of Results:

We do not provide any guarantees of results or legal advice in regards to entrepreneurship or real estate investing, as these fields involve risk and require significant effort. It is always advisable to seek guidance from your own professionals. Any testimonials that showcase our achievements or those of our students should not be considered as standard, typical, or expected outcomes. Some of the testimonials may be from former students who now work as coaches or trainers for RaisingCapital.com. WE DO NOT ALLOW ANY VIDEO RECORDING OF OUR EVENTS FOR DISSEMINATION OR COMMERCIAL USE.

To attend any live event, a valid ticket must be presented for each attendee. The ticket is only valid for the designated day(s) and area(s) of the event as stated on the ticket. Entry into the event is restricted to individuals who meet the minimum age requirements on or before the day of the event. For most events, attendees must be 18 years of age or older, unless otherwise specified for events allowing children. Additional terms or restrictions may apply, which can be found in the event description.

GENERAL PROVISIONS:

Security:

To ensure the safety and comfort of all customers and attendees, admission to any event hosted by RaisingCapital.com and its affiliated companies is subject to strict security arrangements. You acknowledge that we may conduct security checks, such as checks of your person and/or x-ray scans of your clothing, bags, and other items, as determined by us prior to allowing entry to the venue. Please note that we do not permit large bags, backpacks, or luggage at any of our classroom events. Additionally, some venues may have their own rules prohibiting backpacks and large bags.

It is strictly prohibited to bring any explosive substances or materials, pyrotechnics, offensive weapons and firearms (including replica or toy firearms), projectiles and similar devices, sharp items like knives (including Swiss army knives), scissors, cutlery and/or screwdrivers, spray paint, padlocks and/or chains, items that make a noise (e.g. whistles), banners, placards, and/or flags, alcohol, or any other items which in our opinion pose a health and safety risk to, or affect the enjoyment of, other visitors in any way ("Prohibited Items"). If you refuse searches or refuse to leave any Prohibited Items with our security personnel, you may not be permitted to enter the venue or may be ejected from it and required to surrender any tickets you hold without a refund.

Please note that restrictions and additional terms may apply to any event hosted by RaisingCapital.com and its affiliated companies. We recommend that you check the relevant event description for details of any additional terms or restrictions before making a booking. You promise that you, and anyone on whose behalf you make a booking, will observe and comply with any such terms or restrictions.

We cannot guarantee that any User is an “accredited investor,” as defined by Rule 501 of Regulation D under the Securities Act of 1933, as amended.

NOTICE:

Unless explicitly stated otherwise, if you need to send legal notices to RaisingCapital.com, you should email them to Admin@RaisingCapital.com. RaisingCapital.com will provide legal notices to you through email or mailing address you provided during the account registration process, or by posting them on the Site. Once sent, a notice will be considered received 24 hours after being emailed, unless RaisingCapital.com is notified that the email address is invalid. A notice will be considered received three days after being mailed or posted on the Site. By using the Services or the Site, you agree that any notices or communications RaisingCapital.com provides to you electronically, either by email or by posting them on the Site, fulfill any legal requirement for such communications to be in writing.

ARBITRATION:

If there is any dispute or difference between you and RaisingCapital.com, including any officers, directors, or employees, in relation to the Services or any matter concerning these Terms, and you cannot come to a resolution, it will be finally settled by commercial arbitration according to the rules and regulations of the American Arbitration Association ("Association") that are in effect at that time. The parties will mutually select one or more arbitrators from the Association's commercial panel, and the arbitrator(s) must be English speaking individuals. The arbitrator(s) will have the authority to extend the time for issuing the award with the consent of both parties. The award made by the arbitrator(s) can be entered as a judgment in any court that has competent jurisdiction, and it will be final, binding, and non-appealable. The arbitrator(s) can award any remedy or relief that they consider appropriate, including money damages and injunctive relief. This arbitration provision will remain in effect even after these Terms expire or terminate. If any party fails to appear in the arbitration proceedings, the arbitrator(s) may enter an award against that party, regardless of the failure to appear. You consent to the arbitration proceedings taking place in the City of Los Angeles, State of California, and you agree that any legal action or proceeding related to these Terms will occur in the City of Los Angeles. You waive any objections that you may have based on improper venue or inconvenient forum. The arbitrator(s)' fees for the arbitration proceedings will be shared equally between the parties involved.

CHOICE OF LAW:

The Terms and your use of the Services will be governed by and interpreted under the laws of the state of Delaware, regardless of conflicts of laws provisions. You hereby waive your right to a trial by jury regarding any claim, action or proceeding, whether directly or indirectly arising from or related to these Terms of Service to the maximum extent allowed by law. You acknowledge that without this provision, you would have the right to file a lawsuit and have a trial by jury.

FORCE MAJEURE:

Neither party will be responsible for failure to perform any obligation under these Terms due to causes beyond the reasonable control of such party, including but not limited to strikes, lockouts, riots, epidemics, war, government regulation, fire, flood, natural disasters, Acts of God, or inadequacies of equipment, or other cause beyond the reasonable control of such party.

SEVERABILITY:

If any part of the Terms is found to be unenforceable, that part will be changed to the extent needed to make it enforceable while still maintaining its original meaning. If any part of the Terms is found to be unenforceable in a specific jurisdiction, it will be enforced to the maximum extent allowed in that jurisdiction, but the enforceability of the Terms in other jurisdictions and of the remaining provisions in that jurisdiction will not be affected. You also agree to replace any void or unenforceable provision of the agreement with a valid and enforceable provision that will achieve, as much as possible, the economic, business, and other objectives of the void or unenforceable provision.

ELECTRONIC SIGNATURES IN GLOBAL AND NATIONAL COMMERCE ACT/UNIFORM ELECTRONIC TRANSACTIONS ACT:

The Federal Electronic Signatures in Global and National Commerce Act (“ESIGN”) and similar state laws, particularly the Uniform Electronic Transactions Act (“UETA”) laws enable businesses to create legally binding agreements using electronic records and signatures in consumer transactions. To comply with these laws, businesses must obtain the consumer's consent to receive information electronically. When a user registers on the Site, they give their consent to transact business electronically, and the Site maintains electronic records in accordance with ESIGN and UETA regulations. By using electronic signatures to sign documents, users are bound to them in the same way as if they had physically signed them. The use of electronic documents fulfills the requirement for written documents. Users are responsible for reviewing and understanding these documents and agreeing to conduct business electronically. They agree not to contest the admissibility or enforceability of electronically stored copies of this Agreement. While electronic delivery is the preferred method, users may choose other delivery methods, and such a choice will not affect their consent. Users may also opt for paper versions and revoke their consent to electronic delivery, allowing RaisingCapital.com a reasonable period to effect the change. Users must have suitable equipment and services, such as a computer with internet access, an email address, and the ability to download, save, and print communications to retain a record of them. They are solely responsible for maintaining such equipment and services for online access.

WAIVER AND INTEGRATION:

Only the party entitled to the benefit of a provision in these Terms can waive it, and such waiver must be in writing. The failure of any party to require performance of any provision of these Terms at any time will not affect their right to enforce it at a later time. A waiver of any breach of a provision in these Terms will not be considered a waiver of other breaches of the same provision or breaches of other provisions in these Terms. These Terms of Service, along with other referenced materials, represent the entire agreement between RaisingCapital.com and you regarding the Services, superseding all previous or contemporaneous communications and proposals, whether oral, written, or electronic, and govern any future relationship.

CHANGES TO THE TERMS:

When using the Site and Services, you agree to abide by the current version of the Terms in effect on the date of use. The RaisingCapital.com reserves the right to modify the Terms and other policies and procedures governing the Service at any time, without notice or liability, by posting the modified Terms, policies, or procedures to the Site at its sole discretion. The date of any effective changes will be noted at the bottom of this page, and we will provide you with information regarding any changes made upon request. Your continued use of the Services after the modified Terms have been posted or provided to you constitutes your agreement to be bound by the current Terms. 

As of April 26, 2023, these Terms replace the previous terms of December 30, 2021.
